Terms and Conditions of the Future for Kids Foundation Website

I. General Provisions

These Terms and Conditions define the rules for using the website operated by the FUTURE FOR KIDS FOUNDATION, with its registered office at ul. HENRYKA SIENKIEWICZA 40/13, WROCŁAW, post code 50-335, REGON: 540681683, NIP: 8982316386.

The Foundation is a public benefit organization operating under the provisions of Polish law, in particular the Act of April 6, 1984, on Foundations and the Act of April 24, 2003, on Public Benefit Activity and Volunteer Work.

Purpose of the Website

The Foundation's website serves to:

  • present information regarding the Foundation's activities;
  • present information regarding projects conducted by the Foundation;
  • enable Donors to make donations to selected projects or for the Foundation's statutory purposes;
  • publish reports and summaries regarding the progress of fundraising and project implementation.

The Foundation provides Users with its current contact details at the address: www.future-for-kids.pl/contact.

Every User utilizing the Portal is obliged to read the Terms and Conditions and accept their content.

II. Definitions

The terms used in these regulations shall have the following meanings:

Donation
A non-refundable amount constituting a donation within the meaning of the provisions of the Civil Code, transferred by the User for selected projects or for the statutory purposes of the Foundation.
Foundation
The Future for Kids Foundation.
Website
The website operated by the Foundation at the address www.future-for-kids.pl.
User
Any natural or legal person using the website.
Donor
A User who makes a payment (donation) for selected projects or for the statutory purposes of the Foundation.
Project
A specific undertaking conducted by the Foundation, described on the website, including the objective, the required amount, and the total sum already collected.
Account
An individual User profile on the Foundation's website www.future-for-kids.pl, providing access to donation history and reports.
Financial Intermediation Service
External entities through which electronic payments to the Foundation are processed.
Terms and Conditions
This document, specifying in particular the rules and conditions for the functioning and use of the Foundation's website, the rights and obligations of Users, and the rights and obligations of the Foundation.

III. Rules for Using the Website

Use of the Website is voluntary and free of charge.

The User may use the Website without the necessity of creating an Account. However, registration and possession of an Account enable access to making donations and detailed information regarding donations already made.

It is prohibited to use the Website in a manner contrary to the law, good customs, or infringing upon the rights of third parties.

The Foundation shall make every effort to ensure the Website operates continuously and without interference; however, it shall not be held liable for disruptions resulting from causes beyond its control.

Technical Requirements

In order for Users to correctly utilize the functionalities available on the Website, including successful registration and logging in, the following are collectively required:

  • a connection to the Internet;
  • possession of devices allowing for the use of Internet resources;
  • the use of an up-to-date web browser capable of displaying hypertext documents on the device screen, linked via the World Wide Web service, supporting the JavaScript programming language, and accepting cookies;
  • in the case of Users performing registration, possession of an active electronic mail (e-mail) account.

IV. Projects

The “Projects” page presents undertakings conducted by the Foundation.

Project Content

Each Project includes:

  • the objective of the Project;
  • the required amount;
  • the amount already collected (updated in real-time).

The Foundation allocates funds collected within the framework of a Project toward its implementation, and upon its completion, publishes information and a report regarding the utilization of funds on the project page.

Donation Rules

Each amount transferred to the Foundation via available donation channels constitutes a Donation to the Foundation and, as such, is non-refundable (except for cases provided for by law) and (Point V, 5). The User is not entitled to any consideration from the Foundation in exchange for making a Donation. In particular, the Foundation is not liable for public promises made by third parties implying an obligation to provide benefits to the Donor, including, in particular, the transfer of ownership of goods or rights in exchange for a Donation made for the benefit of the Foundation.

Donation Channels

Users may make Donations via Financial Intermediation Services, by transfer to the Foundation's bank account, or using other methods of donating indicated on the Website. The Foundation does not accept cash donations or donations in kind.

E-mail Notifications

After successfully making a Donation in a manner involving the provision of the User's e-mail address to the Foundation, the User shall receive an e-mail notification (this does not apply, in particular, to Donations made by transfer to the Foundation's bank account). The User may also receive the following information at the provided e-mail address:

  • regarding the conclusion of a Collection as a result of reaching 100% of the Project amount;
  • regarding the publication of the Project's result on the Portal;
  • regarding the publication of updates concerning the Project on the Portal;
  • regarding the publication of a subsequent Project on the Portal.

V. Voluntary Payments and Donations

Nature of Payments

  1. All payments made via the Website are voluntary donations for selected projects or for the statutory purposes of the Foundation.
  2. Making a payment does not constitute the purchase of goods or services within the meaning of consumer law.
  3. The Foundation allocates collected funds in accordance with its statutory objectives and Project descriptions.

Rules for Making Payments

  1. The User makes a payment through the electronic payment methods available on the Website.
  2. The minimum and maximum payment amounts may be determined by the Foundation and specified on the Website in each instance.
  3. Making a payment requires acceptance of these Terms and Conditions.
  4. A Donor may make a payment from within Poland or from abroad using the payment methods available on the Website.
  5. Banks and payment service providers, including Financial Intermediation Services, may charge Users fees and commissions in connection with transferring Donations; this includes currency conversion fees for payments in currencies other than the Polish złoty, and they may apply their own exchange rates.
  6. Settlement of transactions related to the transfer of Donations made by wire transfer, with the exception of transfers made directly to the Foundation's account, are carried out through the clearing center of the Financial Intermediation Service.
  7. The total amount of Donations transferred by Users for a given Collection may be visible on the website; however, this amount is indicative and may differ from the total amount of Donations actually transferred.
  8. During the making of a Donation, identification data (signature: first and last name or pseudonym, and the Donation amount) will not be visible to other website users.
  9. By making a payment, the Donor confirms that the funds originate from legal sources.

Confirmations

  1. After successfully making a payment, the User shall receive a confirmation of its registration at the provided e-mail address.
  2. The Foundation maintains records of payments and may issue accounting confirmations in accordance with applicable legal provisions.

User Account

  1. Making a voluntary payment requires providing an electronic mail address.
  2. A personal User panel on the Website is automatically created based on the provided e-mail address.
  3. In the panel, the User has the ability to:
    • view the history of payments made;
    • download annual reports in PDF or CSV format;
    • send a report to a specified e-mail address.
  4. The User receives an e-mail with information regarding the creation of the Account and instructions for the first login and password setting.
  5. The User is obliged to protect Account access data from unauthorized access.
  6. The User may delete the Account independently or request the Foundation to delete the Account by sending an e-mail from the address assigned to the Account on the Website. Deleting the Account results in the inability to log in and further use the Account's functions.
    • Deletion of the Account by the User is equivalent to submitting a declaration of termination of the agreement binding the User with the Foundation with immediate effect.
    • Submitting an e-mail request to delete the Account is equivalent to submitting a declaration of termination of the binding agreement, effective on the day the User is prevented from accessing (logging into) the Account, which shall occur no later than within 30 days.
    • The Foundation may terminate the agreement with the User with immediate effect and delete their Account if the User violates the provisions of these Terms and Conditions or, in connection with the use of the Portal, violates generally applicable legal provisions.

Refunds and Complaints

  1. As a rule, Donations are non-refundable.
  2. Exceptions include situations provided for by law or obvious technical errors (e.g., double charging of a card).
  3. In the event of technical problems related to making a payment or the functioning of the User panel, the Foundation should be contacted using the contact details specified in the Terms and Conditions.
  4. Complaints should be submitted electronically (to the Foundation's e-mail address, entering “Complaint” in the subject line) or in writing.
    • The Foundation shall provide a response to the complaint within 30 (thirty) days from the date of its receipt.
    • The response to the complaint will be sent to the User at the e-mail address specified in the complaint or, if the complaint was submitted in writing, to the address specified in the letter or in writing.
  5. The Foundation informs that complaints regarding services provided electronically by third parties, access to which is related to the Users' use of the Website, are considered by those third parties under the rules and procedures specified in their respective terms of service.

Withdrawal from the Agreement

  1. A User who is a consumer has the right to withdraw from a distance agreement within 14 days of its conclusion by submitting an unequivocal statement of withdrawal to the Foundation, sent electronically to the Foundation's e-mail address: kontakt@future-for-kids.pl.
  2. The right to withdraw from the agreement does not apply to the extent that the payment made constitutes a donation within the meaning of the provisions of the Civil Code.
  3. Withdrawal from the agreement results in the deletion of the User's Account and the cessation of the provision of electronic services, without affecting correctly made and settled payments of a donation nature.

VI. Financial Intermediation Service

Payment processing is handled by external entities with which the Foundation has concluded appropriate agreements (Przelewy24, Apple Pay, Google Pay).

The detailed rules for using the services of Financial Intermediation Services are specified in the terms and conditions of those entities.

Settlement of transactions related to the transfer of Donations made by wire transfer, with the exception of transfers made directly to the Foundation's account, are carried out through the clearing center of the Financial Intermediation Service.

The payment card operator is PayPro SA Settlement Agent, ul. Pastelowa 8, 60-198 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under KRS number 0000347935, NIP 7792369887, REGON 301345068.

VII. Liability

The Foundation shall not be held liable for interruptions in the operation of the Website resulting from technical reasons beyond the Foundation's control.

The Foundation is not responsible for the actions of third parties, in particular payment operators.

The Foundation reserves the right to temporarily suspend the operation of the Website for the purpose of its modernization or maintenance.

VIII. Protection of Personal Data

The controller of personal data is the Future for Kids Foundation.

The Personal Data Protection Officer is listed on the Contacts page.

Personal data of Users and Donors are processed for purposes related to handling donations, maintaining the Account, reporting the Foundation's activities, and for purposes resulting from legal provisions.

The rules for personal data protection are specified in the Privacy Policy available on the Website.

IX. Final Provisions

The current version of the Terms and Conditions is effective as of January 1, 2026.

The Foundation reserves the right to amend the Terms and Conditions. Changes take effect upon their publication on the Website.

In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code and relevant regulations concerning foundations and public benefit activity.
